These terms govern use of the Greenberries One platform ("the Platform") provided by Greenberries ("we", "us"). By signing up for a package or using the Platform, the restaurant business ("you", "the Customer") agrees to these terms. This is a platform-specific agreement for restaurant operations software - not generic website boilerplate.
1. The service
The Platform provides point-of-sale, kitchen display, menu management, payments recording, stock, multi-channel ordering (web and QR, with WhatsApp and delivery platforms as they become available) and reporting, delivered as browser applications, an optional on-site node (Greenberries Edge), and cloud services. Features available depend on your package.
2. Accounts, staff and access
- You are responsible for your owner/manager logins and for staff PINs issued within your organisation.
- Every restaurant's data is isolated; you may only access your own organisation's data.
- Greenberries support access to your data is approved, time-limited and audited.
- You must keep credentials confidential and notify us of any suspected compromise.
3. Hardware
The Platform runs on standard devices with a modern browser. You supply and maintain your own hardware (tablets, screens, the Edge box, printers, networking and power). We can advise on suitable devices but do not warrant third-party hardware. For reliable offline operation across multiple devices, an on-site Edge box and battery backup (UPS) are recommended.
4. Payments
The Platform records cash and card payments and produces receipts and tax invoices. It is a record-keeping and operations tool, not a payment processor: settlement of card payments is handled by your chosen payment provider and card machine. You are responsible for the accuracy of amounts captured and for your own tax and financial compliance, including VAT where you are registered.
5. Availability and offline operation
The Platform is designed to keep core operations (taking orders, kitchen display with Greenberries Edge, and cash payments) running during internet or power interruptions via device-local and Edge storage, syncing to the cloud when connectivity returns. We do not guarantee uninterrupted availability of cloud-dependent features (dashboards, online payment links, live multi-location reporting, third-party channels). Scheduled maintenance will be communicated where practical.
6. Data protection (POPIA)
- We process personal information in line with the Protection of Personal Information Act (POPIA).
- You are the responsible party for your customers' and staff's personal information; we are an operator processing it on your behalf to provide the service.
- Customer contact details are used only for the purposes consented to (such as sending a receipt) and are not used for marketing without explicit opt-in.
- Data is backed up in the cloud. You may request export or erasure of personal data through us.
7. Acceptable use
You may not attempt to breach tenant isolation, access another organisation's data, reverse-engineer the Platform for a competing product, or use it for unlawful activity. We may suspend access for conduct that threatens the security or integrity of the Platform.
8. Fees
Package fees, add-ons and any transaction-based charges are as set out in your order or agreement. Fees are payable in advance unless agreed otherwise. Non-payment may result in suspension after reasonable notice.
9. Liability
The Platform is provided on a commercially reasonable basis. To the extent permitted by law, our liability for any claim is limited to the fees you paid for the Platform in the three months preceding the claim. We are not liable for indirect or consequential loss, or for loss arising from your hardware, network, power supply, or third-party services (payment providers, delivery platforms, messaging providers).
10. Term and termination
Either party may terminate as set out in your agreement. On termination you may request an export of your data within a reasonable period, after which we may delete it in line with our retention policy and legal obligations.
11. Changes
We may update these terms as the Platform evolves. Material changes will be communicated to account owners. Continued use after a change constitutes acceptance.
12. Governing law
These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.
